Failed Termite Inspection?

We are buying a house and yesterday was the termite inspection. All was well until the inspector found some termites outside in a 2x6 piece of wood that had been laying on the ground. He then failed the house, gave the current owner a bill for over 00 and told us the house would have to be treated and the concrete would have to be drilled into before he could pass the house. It sounds fishy to me since there were no termites in/under the house. The house was treated a few years ago and the lifespan of the treatment is 10 years. Do you think this guy was a scam artist?
I just thought I would add that I know it is now the sellers problem, and he knows that it is his responsibility to get a passing termite inspection, I should also add that I live in a part of the country called the East Texas PineyWoods. We are surrounded by woods and therefore termites. It is not uncommon for termites to be in woods near homes. And the house had no termites, it was old wood in the yard.
